Scope: These terms and conditions apply to all guests who book a holiday accommodation (“Holiday Home”) through our website, directly with us, or via third-party platforms such as Airbnb, Booking.com, etc.
1. Subject of the Agreement
1.1 The provider makes a specific holiday accommodation (“Holiday Home” / “Accommodation”) available to the guest. The address and description are stated in the booking form or the booking confirmation.
1.2 The contract applies only for the rental period specified in the booking form (check-in to check-out). It is not a long-term tenancy agreement, but a temporary use agreement in accordance with Dubai Holiday Home regulations.
1.3 The guest receives a temporary right to use the accommodation for the agreed period; there is no entitlement to residential housing in the sense of a long-term tenancy.
2. Booking, Payment & Deposit
2.1 Bookings must be made in writing (via email or through our website booking form). The contract becomes effective once payment of the agreed rental amount is received.
2.2 A deposit / security may be required (e.g., bank transfer or credit card) — payable before check-in.
2.3 The total rental price and all optional additional charges (e.g., final cleaning, extra guests, tourism fee) are listed in the booking form or booking confirmation. Additional fees may only be charged if clearly communicated in advance.
2.4 Any applicable tourism fees (e.g., Tourism Dirham) or other legally required charges are listed separately and displayed transparently.
3. Cancellation, Withdrawal, Changes & Refunds
3.1 Cancellations or booking changes must be submitted in writing (e.g., by email). Details regarding cancellation deadlines, fees, and refunds depend on booking date, rental period, and the booked season (e.g., “more than X days before arrival”, “between X and Y days”, “less than Y days”).
3.2 For cancellations made within less than 7 days before arrival, the full booking amount may be forfeited (depending on agreement). A partial refund may be granted if the accommodation is re-booked — at the provider’s discretion.
3.3 If the provider must cancel the booking (e.g., due to licensing issues, double booking, etc.), any payments already made will be refunded in full, or — if offered — a comparable alternative accommodation will be provided.
4. Check-in / Check-out, Use & House Rules
4.1 Guests must present valid ID documents (e.g., passport or Emirates ID) and contact details at check-in — required for registration with authorities under Dubai Holiday Home regulations.
4.2 The accommodation may only be used by the number of guests specified in the booking form. Visitors or additional guests must be declared in advance and may be subject to fees or denied.
4.3 The guest agrees to handle the property and inventory with care, report damages immediately, and follow all house rules (e.g., noise, neighbours, safety).
4.4 Smoking, pets, parties, or excessive use may be prohibited depending on house rules or community regulations. Violations may result in contract termination and deduction from the security deposit. (House rules are part of these terms.)
4.5 Keys, access cards, or community items must be returned in full at check-out. Costs may apply for loss (e.g., replacement keys or access cards).
5. Liability, Safety & Provider Obligations
5.1 The provider ensures that the accommodation is clean, habitable, and safe upon arrival — including basic utilities (water, electricity), hygiene, emergency information, waste disposal, etc.
5.2 The provider is not liable for the guest’s personal belongings unless caused by gross negligence or intent.
5.3 In cases of damage, theft, or injuries caused by the guest’s negligence, the provider reserves the right to claim compensation. The security deposit may be used for this purpose.
6. Security Deposit
6.1 A deposit or security may be required at check-in (e.g., credit-card pre-authorisation or cash) to cover damages or violations of house rules.
6.2 The deposit will be refunded in full if no damages or violations occur. If damages or violations are found, the provider may withhold appropriate amounts and provide documented evidence.
7. Duration, Extension & Termination
7.1 The contract ends automatically on the agreed check-out date and time.
7.2 An extension of stay is only possible with prior written approval of the provider and may require updated pricing or terms.
7.3 The provider may terminate the contract at any time if the guest violates the terms or house rules — including noise disturbances, unauthorised activities, over-occupancy, property damage, or safety violations. In such cases, the guest may be required to vacate the property immediately, and any payments (including the deposit) may be forfeited.
8. Prices, Additional Costs & Taxes
8.1 All prices include the services listed in the booking form. Additional services (e.g., cleaning, extra guests, late arrival, tourism fees) are listed separately and communicated clearly before booking.
8.2 The guest must pay the indicated price at the time of booking; outstanding amounts must be settled before check-in.
9. Guest Obligations & Conduct
Guests and visitors must follow the house rules of the accommodation and comply with any community or neighbour guidelines.
Quiet hours are between 10:00 PM and 8:00 AM — no noise, parties, or loud activities are allowed during this time.
Visitors may stay overnight only with prior notice; overnight stays by unregistered visitors are not allowed.
Smoking is only permitted in designated areas (if allowed by house rules); otherwise, smoking is prohibited.
10. Legal Regulations, Licensing & Compliance
10.1 The accommodation is licensed as a “Holiday Home” — the provider holds a valid DET license for short-term holiday rentals. This is not a residential tenancy.
10.2 The contract meets all formal requirements of the DET Holiday Home Leasing Regulations: written form (digital or paper), with full details (address, rental period, costs, contact data, guest information, etc.).
10.3 The provider complies with all legal obligations (e.g., safety, hygiene, tax, reporting requirements), and the guest agrees to these conditions when booking.
11. Severability & Changes to Terms
If any provision of these terms becomes invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be replaced by one that most closely reflects the original economic intent.
The provider reserves the right to update these terms at any time — changes will be communicated to the guest before booking and apply only to new bookings.
